WILL OF NEVILL
RUSSELL - 1871
In the name of God Amen.
I Nevel Russell of the County of Carteret and State of North Carolina
being of sound mind and memory, and considering the uncertainty of this
frail and transitory life, and being desirous to adjust and settle my affairs
do therefore make, ordain, publish and declare this to be my last will
and testament viz.
First I give and bequeath
unto my beloved daughter Rebecca M. Pigott the plantation on which
I now live containing one hundred and fifty Acres be the same more or less,
described and bounded as follows viz. commencing at the fork of the middle
prang of Goose Creek turning up said creek to the upper prang near the
McCabe
Place, thence eastwardly up the south and eastern prang to the head, thence
north 30 degrees west to the back line of the stump swampland, thence eastwardly
to a _____, thence south 30 degrees east to the Reuben Wallace line, containing
about one hundred and fifty acres be the same more or less. I also give
to my said daughter all the right, title, claim and interest I hold in
and to the Reuben Wallace tract of land containing about Seventy five acres
be the same more or less.
I Also give to my
said daughter Rebecca M. Pigott one other tract of land on the east
of Camp Branch adjoining the lines of Wm. F. Bell, the heirs of
David
W. Pigott, Stancel C. Bell and Wm. Taylor containing
sixty one acres.
I also give to my
said daughter Rebecca one feather bed and furniture, one cow and
calf, one sow and eight _____, two stocks of bees, ten barrels of corn,
five hundred pounds of pork, fifty pounds of lard, one _____ and implements,
one mahogany table and six setting chairs.
I also give my said
daughter Rebecca M. Pigott my negro man Ben recently known
by the name of Tom, all of the within named property both real and
personal I give to her, her heirs and and assigns forever.
I give and bequeath
unto my three grand daughters Christian P. Smith, Sarah Ann Dixon and
Cassa Russell daughters of Habakuk Russell and Lovy his
wife, All the land I own or possess lying to the west of the line just
made in dividing the land between them and my daughter Rebecca,
turning westwardly with Wm. Taylors line to the corner (Edward
Hills line) thence with Edward Hills line to the Taylors
line thence with the Taylors line down to the A.S. Bell line
thence with the A.S. Bell line to the beginning containing two hundred
and fifty acres of land be the same more or less. To them their heirs and
assigns forever.
I also give and bequeath
to my daughter Rebecca M. Pigott and my grand daughter Christian
P. Smith wife of Jos. Smith fifty acres of land on Bogue Banks
to be equally divided between them their heirs and assigns forever. I further
direct and devise all of my estate remaining unconveyed consisting of stock,
horses, cattle & hogs, household and kitchen furniture, plantation
tools & ect. to be sold to the highest bidder of a credit of six months,
and the proceeds arising therefrom, after the payment of my just debts
and fully settling of my estate to be divided between my daughter Rebecca
M. Pigott and my two grand daughters Christian P. Smith and
Cassa
Russell daughters of Habakuk Russell and my great grand daughter
Jenny Sue Dixon daughter of Wm. Dixon and Sarah Ann
his wife viz. One half of said proceeds to go to my daughter Rebecca
M. Pigott and the other half to be equally divided between my two grand
daughters Christian P Smith Cassa Russell and my great grand daughter
Jenny
Sue Dixon as named above. And it is my further decree that the part
that or going to the said Cassa Russell daughter of H. Russell
and Jenny Sue Dixon daughter of Wm Dixon shall remain in
the hands and under the control of the executor, he being bound to it out
at until each age to Act for themselves or marry.
I likewise make constitute
and appoint Eli W. Sanders Esq. to be executor to this my last will
and testament, hereby revoking all for wills by .
In witness whereof
I have here unto subscribed my name and affixed my seal this 23rd day January
AD 1865.

The execution of the
foregoing will is proved before me according to law by the oath and examination
of Stancel C. Bell on of the subscribing witnesses thereto, who
swears that he saw Nevil Russell execute the same as his last will
and testament that he attested it in his presence and at his request, and
that at the time of its execution he was, in his opinion, of sound mind
and dispossing memory, and further that he saw David Russell sign
the name purporting to be his as subscribing witness to said will in the
presence of the said Nevil Russell, and that said David Russell
is so afflicted bodily that he is incapable of appearing at the Court to
testify as to the execution of said will.
